 Background:

The Federal Ministry of Health is partnering with the Global Fund to Fight HIV/AIDS, Tuberculosis and Malaria (GFATM) and GAVI, the Vaccine Alliance.  FMOH has recently assumed the role of Principal Recipient of GFATM Health System Strengthening grantin Sudan. In its role as Principal Recipient for Health System Strengthening (HSS), FMOH ensures quality financial management, timely procurement of supplies and service delivery as well as efficient monitoring and evaluation of grant implementation. In this regard, a dedicated Program Management Unit (PMU) is set up under the Directorate General of Planning and International Health to manage Health system strengthening projects financed by the GFATM and GAVI. This Unit provides quality assurance and oversight, and guidance to routine management of projects funded by the Global Fund and GAVI. This Unit is now looking for energetic, creative and highly skilled Sudanese professionals to assume the Compliance and Oversight Advisor position.

The Compliance and Oversight Team works under direct supervision of Director General of Planning and International Health and in close collaboration with the Program Manager. The Compliance and Oversight Advisor is a member of the Senior Strategic Management Team which is headed by the Undersecretary of The Federal Ministry of Health.

The main responsibility of this position is to ensure that the PMU and its business maintains an effective, efficient and transparent system of risk management. In this regard the incumbent’s main role is to monitor and report on the levels of compliance with rules and regulations, as well as compliance with government policies and procedures as it applies with the operations of GAVI and the Global Fund programs



 
 Duties and responsibilities:

Under the guidance and direct supervision of the Director General of Planning and International Health and close collaboration with the Program Manager, the Compliance and Oversight Advisor ensures the provision of effective and efficient legal and oversight support services to the PMU within the context of the FMOH-GFATM partnership, including the following tasks:

  1. Ensure oversight mechanisms are in place and enhance business processes for effective system and culture of accountability in managing results & internal procedures.
  2. Coordinate and follow up the internal and external audit exercises and update the senior management on findings, issues, developments and results.
  3. Develop in close cooperation with PMU the Conflict of Interest COI plan and monitor its implementation.
  4. Provide strategic advice and support to program management, program development and monitoring function of the PMU with regard to risk managment, risk mitigation and complaince
  5.  Review, clear and provide advice on procurements and contracts so that actions are taken by senior management before conclusion of each cases.
  6. Oversee contracting processes, ensure integrity, and close alignment with the Global Fund and Government policies and procedures as well as in consultation with procurement staff at Health Project Development Directorate;
  7. Assessing effectiveness of current contracting policy/procedures in meeting donor program needs, identifying opportunities for improvement and developing new procedure options that will shorten contracting period and improve contract management processes;
  8. Providing legal oversight to staff to ensure that their involvement in the acquisition process conforms to established procedures and regulations and that adequate administrative control is in place;
  9. Provide legal input in the development and finalization/negotiation of agreements with all Global Fund and GAVI implementing entities to ensure timely delivery of services and support the PMU team with regard to all operational risk matters and compliance issues.
  10. Provision of legal advice to the Program Manager on the development and drawing-up of realistic legal documentation depending on the needs of the program;
  11. Closely work with the procurement staff of the PMU and Health Project Development Directorate on contracting, quality of performance and timely delivery of services and goods by suppliers and implementing entities and partners;
  12. Closely work with PMU program staff in preparation of realistic work plans in compliance with GFATM and FMOH rules and procedures;
  13. Document and share good practices with in the PMU in terms of an overall risk managment, risk mitigation and compla5ince practices

Staying abreast of best practice and developments surrounding operational risk, risk management and ensure thier widespread understanding with in the PMU and beyond.


 
 Minimum Qualification, Skills and Experience Required:

Education:

  •  A Masters degree in business administration, Finance, law or other related discipline.  Additional experience in procurement/contracts management, acquisition procedures, commercial and international law is an asset.

Experience:

  • Minimum of 3 years of experience in legal advisory services and/or contracts management in public and/or private sector; legal or audit experience in public health area is an advantage;
  • Familiarity with Government of Sudan and International donors program execution modalities, rules and regulations is a distinct asset,
  • Working knowledge of PCs as well as excellent knowledge of Microsoft Windows and Microsoft Office applications;

          The incumbent should also be able to:

  • Demonstrate strong analytical skills and strategic thinking, including a sound understanding of risk management and mitigation strategies and the framework of GFATM and GAVI cooperation with the Government of Sudan.
  • Focus on impact and results; and responds positively to feedbacks and openness to change
  • Consistently approach work with energy and a positive, constructive attitude.
  • Demonstrate resourcefulness, initiative and ability to meet tight deadlines and work in teams harmoniously even under pressure
  • Promote knowledge sharing and learning culture in the office

Language Requirements:
Fluency in both written and spoken English and Arabic
