 Background:

The Legal Specialist advises on corporate, institutional and commercial legal issues pertaining to UNDP Country Office in Sudan. The Legal Specialist, in consultation with the UNDP Headquarters Legal Support Office, handles matters involving complex issues of private, comparative and international law. The Legal Specialist also advises in matters pertaining to overall policy and strategic issues, ensuring that the mandate of the Organization as established by its governing bodies is adhered to in its operational and legal framework. The Legal Specialist serves as counsel for Country Office, Programmes and Projects, as well as for UNDP’s affiliated funds – UNIFEM, UNDSS and UNV.


 
 Duties and responsibilities:

Under the overall guidance of the Deputy Country Director (Operations) and the direct supervision of the Operations Manager, the Legal Specialist shall provide legal advice and services required by the Country Office in its day-to-day operations, on commercial and institutional matters. The Legal Specialist will closely collaborate with the Legal Support Office of (LSO)/Bureau of Management in New York. Specific duties: •Consult with the Legal Advisor for Commercial and Institutional Matters in LSO on all matters relating to the privileges and immunities of the Organization, including modification of General Conditions of Contract. •Provide legal advice on commercial law, including contracts and claims, operational agreements between UNDP and various stakeholders, private sector partnerships and UNDP regulations, rules and procedures in all matters affecting the Country Office, except matters relating to the Staff Regulations and Rules which are handled by LSO. •Review and modify operational agreements, as necessary and appropriate, of the country office including agreements with governmental entities and project documents. Significant departures from model texts must be coordinated with LSO. •Participate in the analysis and reengineering of procedures and strategies particularly with respect to flow of work between the Business Centre, external bodies and other units within UNDP. Make proposals towards the increase of productivity of the Business Centre with a streamlining of operations for greater efficiency and accountability. •Assist and provide legal advice in the resolution and avoidance of contractual disputes with particular emphasis on establishing preventive measures for the future. Provide advice on the resolution of complaints and other legal demands presented to the Country Office. Liaise with LSO in cases where the Country Office is not able to resolve the dispute locally and before formal dispute resolution is instituted and promptly in all cases of notice of court litigation. •Review and improve proposed modifications to standard form contracts and procurement documents in use by the Country Office, in consultation with LSO. •Supply direct assistance and advice to the Office Management on contracting and other administrative matters, when requested. •Prepare/review TORs of legal consultancies, when required, in consultation with LSO. Serve as counterpart for legal consultants. • Other duties as required. Documentation and views to be considered: The Legal Specialist shall, inter alia, refer to the existing Programme and Operations Policies and Procedures and standard forms used by the Country Office and all material relating to existing UNDP rules and regulations. In addition, when necessary, the Legal Specialist shall familiarize him/herself with the political and commercial system of Sudan. Consultative meetings shall be held when needed with relevant stakeholders within UNDP, Members of the Government and other development partners.  Minimum Qualification, Skills and Experience Required:

Education: •Master Degree in Law, Attorney at Law or equivalent admission to the bar a definite advantage. Experience: At least 5 years legal experience with a private law firm, a government or international organization; •Strong experience in practicing law in international environment with in-depth experience in contracting and commercial law •Experience with the United Nations a definite advantage •Ability to work independently and as a team member in an international environment •Solid cross cultural and interpersonal skills •Proven problem solving skills •Computer skills (specifically Word, Excel, Internet, Email) Language: •Fluency in English and Arabic
